By means of the present application, the applicants seek anticipatory bail in connection with Criminal Case No. 3016 of 2021 arising out of F.I.R. No. 6 of 2021, registered at Police Station Transit Camp, District Udham Singh Nagar, for the offences punishable under Sections 498-A and 506 of the I.P.C. and Sections 3/4 of the Dowry Prohibition Act, 1961. 4. Learned State Counsel, on instructions received from the Investigating Officer, submits that the investigation has already been concluded and the charge-sheet has been filed before the competent Court. 5. Learned counsel for the applicants would submit that during the pendency of the present anticipatory bail application, applicant no.3 expired on 19.11.2024. He would further submit UKHC010155222023 2026:UHC:6683 that a Coordinate Bench of this Court, vide order dated 25.09.2023, had granted interim anticipatory bail to the applicants; that, pursuant to the said order, the applicants appeared before the Investigating Officer as and when required and extended full cooperation during the course of investigation; that, the investigation now stands concluded, the charge-sheet has already been submitted before the competent court, and no material has been placed on record to indicate that the custodial interrogation of applicant Nos.1 & 2 is either necessary or warranted at this stage. It is, therefore, prayed that the interim anticipatory bail granted in favour of applicant Nos.1 and 2 be confirmed and made absolute. 6. Having heard learned counsel for the parties, perused the material available on record, and considering the submissions advanced, this Court finds that the applicants have remained protected under the interim order dated 25.09.2023. The investigation has since been completed and the charge-sheet has already been filed before the competent Court. There is nothing on record to demonstrate that the custodial interrogation of applicant nos.1 and 2 is now required for any further investigation. In these circumstances, and without expressing any opinion on the merits of the case, this Court is of the considered opinion that the interim protection granted in favour of applicant nos.1 and 2 deserves to be confirmed. Insofar as UKHC010155222023 2026:UHC:6683 applicant No.3 is concerned, it is not in dispute that he expired on 19.11.2024; accordingly, the present anticipatory bail application, to that extent, has become infructuous. 7. Consequently, the interim anticipatory bail granted to applicant Nos.1 and 2 by the Coordinate Bench of this Court vide order dated 25.09.2023 is made absolute. The applicant nos.1 and 2 shall continue to remain on anticipatory bail on the same terms and conditions as contained in the aforesaid order dated 25.09.2023, subject to due compliance thereof and subject to any further condition(s), if any, imposed by the trial Court in accordance with law. 8. The anticipatory bail application is, accordingly, allowed in respect of applicant Nos.1 and 2. Insofar as applicant No.3 is concerned, the application stands disposed of as having become infructuous on account of his death. 9. Pending applications, if any, also stand disposed of.
