JUSTICE SANJEEV KUMAR SHARMA ORDER 29.06.2026 Heard Mr. C. Tlanthianghlima, learned Legal Aid Counsel representing the applicants/appellants. Also heard Mr. Victor L. Ralte, learned counsel for respondent No. 1, and Mrs. Caroline K. Lungawipuii, learned counsel for respondent Nos. 2, 3 & 4. This I.A. has been preferred seeking condonation of delay of 97 days in preferring the connected appeal and against the impugned Judgment & Decree dated 18.09.2025 passed by the Court of Addl. District & Session Judge-III, Aizawl Judicial District, Aizawl in RFA No. 31/2024 arising out of Civil Suit No. 83/2016. An objection has been filed on behalf of the respondent No. 1. The learned counsel for respondent Nos. 2, 3 & 4 submits that she has no objection to the condonation of delay. On perusal of the I.A., it appears that, in substance, the applicants/appellants were prevented from approaching the Court because of the time taken up in legal Consultation and also due to financial constraints. It Page No.# 5/5 appears that the applicants/appellants had to seek the help of the High Court Legal Service Committee and a Legal Aid Counsel has been appointed to represent them. In the objection filed on behalf of the respondent No. 1, it is stated, inter alia, that the applicants/appellants have not been able to provide sufficient explanation for the delay in obtaining certified copies as well as making legal consultation. Upon perusal of the record and on hearing the learned counsel for the parties, I am of the view that the delay of 97 days has been sufficiently explained. Accordingly, the delay stands condoned and the I.A. stands allowed. List the connected appeal for admission in 20.07.2026. JUDGE Comparing Assistant
