HON’BLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.24496 of 2026 ORDER: This Writ Petition is filed questioning the action of Respondents in withholding/not considering the candidature of the Petitioner for promotion to the post of Regional Transport Officer (RTO) without reference to the Charge-Memo issued vide Charge Memo No.20024/5/V2/2021-1, dated 05.11.2025 as illegal and arbitrary. 2. Petitioner was initially joined the service as Assistant Motor Vehicle Inspector in Transport Department on 28.03.1994 and got promotion as Motor Vehicle Inspector on 05.07.2005. While so, Respondent No.2 issued impugned Charge-Memo alleging that in the surprise check conducted by the ACB Officials on 05.03.2021, Petitioner failed to account for the unauthorized amount of Rs.2,51,950/- allegedly collected from drivers and cleaners of lorries passing through the Check Post through private agents. 3. The Petitioner submitted his explanation to the Charge-Memo denying the Charges framed against him and requested to drop further action. However, no further steps have been taken by the Respondent-authorities to finalize the enquiry as per the guidelines 2 issued by the Government from time to time to conclude the enquiries. Hence, the present Writ Petition is filed. 4. During the course of arguments, learned counsel for the Petitioner Sri Eluru Sesha Mahesh Babu submits that though the Charge-Memo is issued in the month of November, 2025, as on date there is no progress in the enquiry and he restricts his relief in the Writ Petition to the extent of promotion only and would submit that the case of the Petitioner may be considered for promotion. 5. Learned Assistant Government Pleader for Services-I Sri S. Raju would submit that the enquiry would be concluded, as expeditiously as possible, and the case of the Petitioner for promotion would be considered in terms of G.O.Ms.No.257, dated 10.06.1999. 6. Having heard the respective counsels, the Writ Petition is disposed of, with the following directions; (i) The Respondents are directed to consider the case of Petitioner for promotion to the post of Regional Transport Officer subject to the Petitioner possessing requisite qualification in terms of G.O.Ms.No.257, General Administration (Ser.C) Department, Dated 10.06.1999; (ii) No order as to costs. 3 7.
