The grievance urged in the present writ petition is that the proposed road Rawatgaon-Kanda-Jevala is being laid at a considerable higher alignment as compared to the village abadi and also at a substantial distance. Consequently, it would not be of much utility to the petitioner and the villagers for whose benefit, the road is being constructed. On the said ground, the petitioner has challenged the tender notice dated 18.06.2026, issued by Executive Engineer, Public Works Department, Provincial Division, PWD, Tehri, District Tehri Garhwal. The petitioner has also prayed for a writ of mandamus commanding the respondents to decide the representations made by the petitioner; and the villagers before commencing the construction work. 1 UKHC010134892026 2026:UHC:6660-DB 2. The alignment of the road is to be decided by the experts and this Court, by issuing a writ of mandamus cannot compel the authorities to change the alignment of the road. 3. However, liberty is given to the petitioner to press the representation stated to have been made by him on 26.02.2026, before the Executive Engineer, Public Works Department, Provincial Division, PWD, Tehri, District Tehri Garhwal. It is further directed that upon the petitioner filing copy of the instant order along with copy of the aforesaid representation before respondent no.3, within one week from today, the same shall be considered and decided by respondent no.3 by passing a speaking order within next three weeks. 4.
