Versus The State of West Bengal Mr. Navanil De Mr. Srinjan Ghosh. …for the petitioners. Ms. Sreyashee Biswas Ms. Suparna Chatterjee. …for the State. Learned advocate appearing for the petitioners submits that there was alleged recovery from the house of the petitioners 297 bottles of Codeine phosphate, 257 strips of Alpra Zolam Tablets and 36 strips of Nitrazepam Tablets and another 60 ampoules of avail injunction. It has also been contended that the petitioner no.2 was arrested from the spot and he is in custody for 8 months 8 days while the petitioner no.1 is in custody for more than 7 months. Learned advocate for the petitioners submits that the petitioner no.2 has a pharmacy licence and, as such, he has been falsely implicated in connection with the instant case. Learned advocate for the State opposes the prayer for bail and submits that there are overwhelming materials so far as the petitioners are concerned and the contraband which has been 2 seized. Having considered the period of detention of the petitioners and the time which will be consumed for taking the trial to its logical conclusion, I am of the view that further detention of the petitioners is unwarranted. Accordingly, the prayer for bail of the petitioners is allowed. The petitioners, namely, Jahirul Islam @ Jaharul Islam and Jiarul Hoque shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional Sessions Judge, 1st Court, Raiganj, Uttar Dinajpur. If on bail, the petitioners shall be physically present on each and every date fixed by the learned special court and shall not leave the district of Uttar Dinajpur without prior permission of the learned special court. Accordingly, CRM(NDPS) 521 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
