Learned advocate appearing for the petitioner submits that the subject matter of the case relates to alleged recovery of 100 bottles of phensedyl. Charge-sheet has been submitted and charges have been framed in connection with the instant case. Learned advocate for the State opposes the prayer for bail. Records reflect that prosecution has relied upon 14 witnesses. Having considered the number of witnesses relied upon by the prosecution, I am of the opinion that some time will be required to take the trial to its logical conclusion. As such, further detention of the petitioner who is in custody for more than three months is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed. Thus, petitioner namely, Arun Saha shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only),
2 with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act, Balurghat, Dakshin Dinajpur. If on bail, the petitioner shall be physically present before the learned Special Court on each and every date and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 538 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
