The Petitioners seek the leave of this Hon'ble Court to withdraw the above Writ Petition as the First Respondent Police have filed a final report in the form chargesheet and the Hon'ble Trial Magistrate - 3 - HC-KAR NC: 2026:KHC:18886 WP No. 34749 of 2025 has allegedly taken cognizance for the offences made penal under Sections 74, 115(2), 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023 as against the Petitioners herein who are arraigned as Accused Nos 1 and 2, arising out of Crime No.347 of 2025 and has issued summons. 2. The Petitioners above named had only challenged the registration of the Crime supra and vide order dated 11.03.2026 this Hon'ble Court was pleased to grant an Interim Order of stay of all further proceedings and investigation of the said Crime in the above petition. During the pendency of the above Writ Petition, the Final Report in the form of Chargesheet and the Order of cognizance and summons has been passed by the Trial Magistrate, making the above Writ Petition infructuous. 3. The Petitioners herein have filed a fresh and a separate writ petition challenging the Final Report in the form of Chargesheet as well as the Impugned order of cognizance and issuance of summons. WHEREFORE, the Petitioners above named most humbly prays that this Hon'ble Court be pleased to permit him to withdraw the above Writ Petition, with liberty to challenge the chargesheet in the ends of justice.” In terms of the memo, the writ petition is disposed as withdrawn.
