JUSTICE MANOJ JAIN O R D E R % 21.05.2026 1. Applicant seeks regular bail in FIR No. 596/2020 dated 07.12.2020, registered at P.S. Mayur Vihar, for commission of offences under Section 365 IPC. Subsequently, in the charge-sheet, offences under Sections 302/120B/34 IPC. 2. The abovesaid FIR was registered on the basis of complaint made by one Arjun Kumar whose wife Chandni was missing and he suspected that there was involvement of her family members as their marriage was inter-caste and the family members were not happy with such marriage. 3. During investigation, the police arrested all three brothers of the missing girl and then it came to fore that she had been killed by them. 4. On the basis of disclosure made by the accused Sunil on 09.12.2020, the dead body of their sister was recovered. 5. The applicant herein was arrested later on. 6. The applicant is also real brother of Chandni and according to him, he has no role or participation in the offence in question and he has been arrested, merely, on the basis of disclosure statement made by his brother Sunil. All the concerned material public witnesses have already been examined. 9. Learned APP for the State submits that his conduct is sufficient to infer his involvement in the conspiracy in question as, when he was earlier contacted during the investigation, he tried to mislead the police. Fact, however, remains that when asked, learned APP, in all fairness, submits that there is no other specific incriminating or corroborating material other than his conduct and he had been arrested on the basis of suspicion expressed by husband of deceased and on the basis of disclosure of co-accused. 10. There is no eye-witness as such and case is based on bunch of circumstances. 11. There are 26 prosecution witnesses in the present matter and so far, only 5 witnesses have been examined. 12. Keeping in mind the overall facts of the case and the period of incarceration undergone by the applicant which is more than five years as on date, albeit, without expressing any opinion over the merits of the case, the applicant is, hereby, directed to be released on bail on his furnishing personal bond in a sum of Rs. 25,000/- with one ‘local’ surety of like amount, subject to the satisfaction of learned Trial Court/CJM/Duty Magistrate with following conditions:- (i) The applicant would provide his Mobile Number and would ensure that such Mobile Number remains active and operational, till the disposal of the case by the learned Trial Court. (ii) The applicant would not try to come in contact of family members of deceased, directly or indirectly. This is a digitally signed order.
