This application filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, the accused petitioner namely, Jahidul Islam, has prayed for bail in connection with Goalpara P.S. Case No. 65/2026 u/s 61(2)/329(4)/87/296 of BNS, 2023 r/w Section 6 POCSO Act, 2012. 3. The petitioner was arrested on 28.04.2026. 4. The FIR was lodged by the father of the victim girl, alleging that the accused/petitioner was trying to having a love relationship with his 15 years old daughter and subsequently, taking advantage of the situation, the petitioner illegally entered his house and after inducing her, took her to Guwahati and committed physical relation upon her against her wishes. 5. It is submitted by the learned Additional Public Prosecutor that in the meantime, investigation stands completed resulting in a charge-sheet. It is submitted that the victim was a minor at the time of the incident and he opposes to grant of bail to the petitioner at this stage. 6. The learned counsel for the informant has filed an affidavit. It is submitted that there was indeed a love relationship between the victim girl and the petitioner who stated to be aged 19 years. Drawing attention to Para 4 of the affidavit, it is submitted that both the families are discussed the matter and decided to solemnize the marriage between the victim girl and the petitioner after she attains majority. 7. In the given facts and circumstances and considering the above aspect as well as the completion of the investigation – it would be proper to grant bail to the petitioner, subject to strict conditions. 8. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Goalpara P.S. Case No. 65/2026 u/s 61(2)/329(4)/87/296 of
Page No.# 3/3 BNS, 2023 r/w Section 6 POCSO Act, 2012, on furnishing bail bond of Rs.30,000/- with one suitable surety of the like amount to the satisfaction of learned concerned court. 9. The direction for bail is further subject to the conditions: (a) That the petitioner shall not hamper or tamper with evidence; and (b) That the petitioner shall not commit any harm or harassment to the victim or her family members. 10.
Violation or breach of any condition(s) shall entail cancellation of bail. 11. With the above observations, this bail petition stands allowed and
disposed of accordingly.
