In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 354 of 2025 dated 05.03.2025 under Sections 21(c)/27A/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and 25 days and although charge sheet has been submitted but till date charges have not been framed. It has also been contended that the quantum of seizure is 490 Gms. of Morphine.
Attention of the Court is drawn to the Chemical Examiner’s Report which contains Morphine, Codeine and Thebaine and covered under the NDPS Act which are not quantified.

Learned advocate relies upon the judgment of the Hon’ble Supreme Court in Sentu Seikh vs. State of West Bengal (SLP (Crl.) No. 13987/2025).
Learned advocate for the State opposes the prayer for bail as commercial quantity of recovery has been made. Having considered the period of detention and the fact that quantification has not been specified, I direct that the learned Trial Court, after the stage of consideration of charges are over, would release the petitioner on bail on such terms and conditions as he deems fit and proper for ensuring further appearance during the trial.
With the aforesaid directions CRM (NDPS) 487 of 2026 is disposed of.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
