Petitioner is serving as Head of Department, Computer Science and Engineering in Government Polytechnic, Kotabagh, District Nainital. According to petitioner, she served in Government Polytechnic Almora between 29.10.2004 to 06.07.2009; at that time, Government Polytechnic, Almora was categorized as accessible (Sugam) area, however in the classification made by competent authority vide order dated 17.05.2022, Government Polytechnic, Almora was categorized as Durgam (inaccessible). Petitioner is aggrieved by order dated 31.05.2022 passed by Director, Technical Education, wherein it is provided that change of category of government polytechnic will not entitle a teacher to claim benefit of having rendered service at a Durgam place, and if at the time of his/her posting, concerned government polytechnic was categorized as Sugam, it cannot be later treated as Durgam, even though category gets changed. He submits that petitioner has no reason to challenge the order passed by Director, Technical Education on 31.05.2022. Learned Counsel further submits that the Director, Technical Education be directed to take decision thereupon. 5. Accordingly, without making any observation as to the merits of claim of petitioner, present writ petition is disposed of with a direction to the Director, Technical Education to take decision on the representation of petitioner dated 03.06.2022 (Annexure No.6) within a period of six weeks as per law. 6.
