Rampur, District- Balrampur, State- Chhattishgarh … Petitioner -Versus- The State of Jharkhand … Opposite Party ----- CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI ----- For the Petitioner : Mr. Ritesh Kumar, Advocate For the State : Mr. Santosh Kumar Shukla, A.P.P. ----- 05/05.05.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Gumla (Mahila) P.S. Case No.24/2025, registered for the offence under Section 69 of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of the learned Sub Divisional Judicial Magistrate, Gumla. 3. Learned counsel appearing for the petitioner submits that the petitioner and informant have come into contact in the year 2024 and what has happened that was consensual in nature, however, the FIR has been lodged on 18.10.2025. He further submits that false allegation is made of establishing relationship on the pretext of marriage. To buttress this argument, he refers to WhatsApp chat annexed with the FIR itself and submits that even money has been demanded to the tune of Rs.5 Lakhs by the informant to release the petitioner. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioner. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of establishing relationship on the pretext of marriage. ( 2026:JHHC:13252 ) -2- A.B.A. No. 327 of 2026 5. Looking into the contents of the FIR, it transpires that friendship was established between the petitioner and informant in April, 2024 and it was continued and in the meantime, they have also established relationship. Prima facie, in light of the WhatsApp chat, which is part of the FIR, it transpires that what has happened that was consensual in nature and even as per the WhatsApp chat, the informant has demanded sum of Rs.5 Lakhs from the petitioner. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Gumla in connection with Gumla (Mahila) P.S.
