JUSTICE ALOK KUMAR SINHA ORAL ORDER 3 19-03-2026 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. 2. The petitioner seeks bail in connection with Cyber P.S. Case No. 63 of 2025 registered for the offence punishable under Sections 316(2), 318(4), 308(2) of the B.N.S., 2023 and Sections 66(c), 66 (d) of the Information and Technology Act, 2000. 3. The case of the prosecution is that the informant developed friendship with the accused Yogesh Suresh Chauthe through Facebook since the month of June 2018. Gradually, the friendship developed and reached on its peak. The informant believed his flattering words as true version. Taking the informant in his good book the accused petitioner saying and Patna High Court CR. MISC. No.8751 of 2026(3) dt.19-03-2026 2/3 showing his letter written with blood on video calling and as such he impressed much to the informant and the informant falling in love wrongly. Since February 2019, the accused petitioner started demanding money showing his urgent need on the assurance to return the same with interest. When she hesitated, the accused petitioner threatens to suicide himself and implicate the informant. On his threatening and blackmailing, the informant was enticed altogether Rs. 25,13,500/- through different modes like account transfer, Paytm etc. and gold jewelleries total 267.5 grams. Even presently he was asking Rs. 6 lakhs to deposit tax by threatening on various ways. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to ulterior motive. The allegations made in the FIR are false, frivolous and have been lodged with malafide intention. He further submits that the petitioner has no criminal antecedent and is in custody since 28.08.2025. 5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner. 6. Considering the aforesaid facts and circumstances of the case as also the fact that the petitioner is in custody since Patna High Court CR. MISC. No.8751 of 2026(3) dt.19-03-2026 3/3 28.08.2025 and chargesheet has already been filed on 18.10.2025, this Court is inclined to grant privilege of bail to the petitioner. 7. Let, the petitioner, named above, is directed to be released on bail on furnishing bail-bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Cyber P.S. Case No. 63 of 2025, subject to the following conditions:- (i) One of the bailors of the petitioner shall be his close relative. (ii) The petitioner shall remain physically present in Court on each date of the trial. (iii) In case of absence on two consecutive dates without substantial reason or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned. 8.
