It is submitted that pursuant to the complaint dated 10.05.2024, filed by the 3rd Respondent, the Old Goa Police registered FIR No. 127/2025 against the Petitioners by invoking Sections 427, 447, 504, 324, 506 (ii) read with Section 34 of the IPC and Section 92 (b) and (e) of the Rights of Persons with Disabilities Act, 2016. 3. After the investigation, the Respondent No. 2 has filed a chargesheet against the Petitioners on 04.05.2026. However, in view of the fact that the Petitioners and the 3rd Respondent are family members, they have settled the dispute amicably and the 3rd Respondent has filed an affidavit dated 17.09.2026 giving his consent for quashing the FIR and the chargesheet. 4. There are also consent terms filed by the Petitioners and the 3rd Respondent, which the Petitioners and the 3rd Respondent have executed on 17.09.2026. The affidavit as well as the consent terms are taken on record and marked ‘X’ and ‘Y’ respectively for the purpose of identification. Manoj J. Mahale & 4 Ors. Vs. It is submitted that the consent terms and the affidavit dated 17.09.2026 are executed on own freewill of the 3rd Respondent. Hence, it is jointly submitted by the Petitioners and the 3rd Respondent that the FIR and the chargesheet be quashed and set aside. 6. In view of the fact that the dispute arose between the family members and that the parties have amicably settled the same, I am satisfied that the FIR and the chargesheet ought to be quashed and set aside in the interest of justice, particularly when the dispute between the parties is of a civil nature. I am also satisfied that continuing the trial would serve no useful purpose when the parties have amicably settled the dispute. 7. Therefore, FIR No. 127/2025 dated 29.10.2025 registered at the Old Goa Police Station and the Chargesheet No. 32/2026 initially filed before the JMFC, ‘E’ Court, Merces and now pending before the Sessions Court, North Goa, Merces under Registration No. SCORS/88/2026 are quashed and set aside. 8. However, because the parties have misused the criminal justice system for a civil dispute, the Petitioners shall jointly pay costs of Rs.25,000/- Manoj J. Mahale & 4 Ors. Vs.
