This appeal is directed against the order dated 06.01.2026 passed in B.P. No.02 of 2026, arising out of Hiranpur P.S. Case No. 105 of 2025, by the learned Additional Sessions Judge-I, Pakur, whereby and where under the prayer for bail of the appellant has been rejected. 3. It has been alleged that on account of blasting in mines, stones had fallen in the courtyard of the house of the villagers and cracks had also appeared in several houses and roads. When the said incident was protested by the villagers, the mines owner along with his associates variously armed had abused and assaulted the villagers as a result of which one of the villagers had sustained a simple injury. 4. Submission has been advanced by the leaned counsel for the appellant that several of the co-accused persons including the owner of the mines have been granted anticipatory bail by this Court. It has been submitted that the appellant is in custody since 18.12.2025. 5. Learned Spl.P.P. has opposed the prayer for bail of the appellant. 6. On consideration of the fact that the appellant was merely a labour working in the mines and similarly situated co-accused persons have already been granted anticipatory bail by this Court, we while setting aside the order dated 06.01.2026 passed in B.P. No.02 of 2026, arising out of Hiranpur P.S. Case No. 105 of 2025, by the learned Additional 2026:JHHC:755-DB 2 Sessions Judge-I, Pakur, direct the appellant to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Pakur. 7.
