Heard Mr. B. Chowdhury, learned counsel for the petitioner. Also heard Mr. B. Sarma, learned Additional Public Prosecutor for the State.
2. This application has been filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the accused petitioner namely,
Page No.# 2/3 Partha Barman, has prayed for bail in connection with Barpeta Road P.S. Case No. 19/2026 under Section 103(1) of BNS, 2023.
3. The petitioner was arrested on 07.03.2026.
4. The FIR was lodged by the brother of the deceased with allegation that his sister was married to the petitioner who used to inflict mental torture upon her and seems to relate the torture of the accused. It is further alleged that on 06.03.2026, the accused called the informant and informed that his sister had committed suicide, whereupon he rushed there and saw her dead body. It is alleged that he suspects that the accused person had killed his sister and hanged her.
5. The learned counsel for the petitioner has submitted that the case is poised for commencement of prosecution evidence upon framing of charges and he may be granted bail to prepare his defence. The statements of some witnesses recorded during investigation including one cousin sister stated to be a neighbor as well.
6. The scanned TCR has been received. The final opinion regarding that indicates asphyxiation due to ante-mortem suicide and hanging.
7. The learned Additional Public Prosecutor for the State submits that the case is fixed for commencement of prosecution evidence on 02.07.2026 and that, bail can be taken up for consideration after examination of the initial crucial witnesses.
8. I have given my anxious consideration to the entire matter; in the circumstances, I deem it prudent to reject the bail petition at this stage

9. The bail petition stands disposed of.
