Learned counsel for the petitioner submits that the petitioner is in custody since 28.04.2025 in connection with Pachamba P.S. Case No.52/2025, registered under Sections 64 (1)/351 (2) of Bharatiya Nyaya Sanhita, now pending in the court of learned Additional Sessions Judge – V, Giridih in S.T. No.436 of 2025. 3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. However, the charge sheet has already been submitted. He has further submitted that the petitioner and the victim belonged to the same village and there is delay of lodging the F.I.R. by 2 days and in the medical evidence, no sign of rape has been found and it is impossible that the petitioner could have approached the victim at 2.30 at night and commit rape upon her. 4. The learned counsel for the State has opposed the prayer for bail by submitting that there is direct allegation against the petitioner supported by the statement of the witness and the victim recorded under Section 183 BNSS. 5. The perusal of the F.I.R. reveals that there is direct allegation against the petitioner and in the impugned order itself it is recorded that the victim has supported the allegations made in her statement recorded under Section 183 BNSS. 6. Since there is direct allegation against the petitioner supported by the statement of the victim and also the statement of the witnesses as recorded under Section 183 BNSS, this Court is not inclined to 2026:JHHC:11455 2 enlarge the petitioner on bail. 7.
