P.P. …...... 02/ 30.03.2026: This bail application has been filed by the petitioner under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Section 103(1) of BNS and Section 27 of the Arms Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned AddI. P.P. opposes the prayer for bail. 4. It is the prosecution case that the informant’s son namely, Rajkuamr Yadav was murdered by unknown persons. 5. Petitioner is not named in the F.I.R. nor there is direct allegation against this petitioner. 6. After going through the records, I find that admittedly the petitioner is not named in the F.I.R. The only materials against this petitioner as appears from the case diary is that he made confessional statement in which he has allegedly admitted his guilt and a country made pistol was recovered from the field of Abhisekh Yadav at the instance of the petitioner. There is no FSL report to suggest as to whether the said pistol was used in the occurrence or not. The chargesheet has already been submitted. 7. Considering the aforesaid materials which collected during investigation, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sahibganj, in connection with Sahibganj Muffasil P.S. Case No.92 of 2025, subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand with a further condition that the petitioner shall appear and mark his attendance before the Registrar, Civil Court, Sahibganj once in a month till the disposal of the trial.
