To prove the same, he produced the bank statement. Therefore, he prayed to modify the condition imposed to get the car under his custody till the disposal of criminal proceedings in Crime No.145 of 2025. 3.The learned counsel for intervenor/defacto complainant raised objections stating the E.M.I. amount was paid by her husband and not by the petitioner, who is his brother. After the demise of his brother, there is some dispute arose between them. But, as on date, the car is under the custody of petitioner. 4.To prove the payment of E.M.I., the learned counsel for petitioner produced the bank statement. Whether they are relevant for the payment of E.M.I., it will be decided only at the time of trial. Considering that, this Court is https://www.mhc.tn.gov.in/judis CRL MP No. 1507 of 2026 __________ Page3 of 4 inclined to modify the condition imposed by this court by an order dated 12.11.2025 as rightly objected by learned Government Advocate appearing for 1st respondent, the petitioner is directed to deposit a sum of Rs.3,00,000/- to the credit of Crime No.146 of 2025 within a period of four weeks from the date of receipt of copy of this order. 5. The learned counsel for intervenor/defacto complainant also pointed out that after passing the order by this court, the R.T.O. had transferred the vehicle in the name of deceased Chandrasekaran. If at all, any encumbrance made over the car, it will lead to other multiplicity of proceedings. Therefore, this court is inclined to impose one more condition that the petitioner is directed to keep the car without making any encumbrance over the car till the disposal of criminal proceedings. 6.
