Sarma, learned Addl. Public Prosecutor, Assam for the State respondent. Page No.# 2/2 2. This is an application under Section 482 of BNSS, 2023 in connection with Barpeta P.S. Case No. 136/2026 (Corresponding to G.R. Case No. 441/ 2026), registered under Sections 331(4)/ 305(a) of BNS, 2023, for granting of anticipatory bail to the accused/petitioner. 3. As per the allegation in the FIR, some unknown persons trespassed into the house of the informant and had stolen a trunk containing valuable cloths and cash. 4. It is submitted by the learned counsel for the petitioners that the present petitioners are not named accused in the FIR and money has also been recovered. 5. The learned Add. Public Prosecutor with reference to the case diary has submitted that although the petitioners are not named accused in the FIR where there is sufficient incriminating materials against the petitioners in the case diary, only part of the cash, amounting to Rs. 5,00,000/- have been recovered and other amounts of recovery are yet to be made. 6. Hence, it is not fit case to grant the pre-arrest bail to the petitioners and accordingly, the prayer for bail stands rejected at this stage. 7. The petition is dismissed. 8.
