This is an application filed by the petitioner seeking preponment of the date of hearing. With the consent of the learned counsel for the parties, the date fixed in the main petition is preponed and same is taken up for consideration today itself.

CRM(M) No. 112/2026:
Through the medium of present petition, the petitioner is seeking expeditious trial of the case arising out of Challan bearing Nos. 265/2015, 266/2015, 267/2015, 268/2015, 269/2015, 270/2015, 271/2015, 1056/2015 and 1111/2016 which are stated to be pending before the court of Special Judge CBI Cases, Srinagar.

It is case of the petitioner that he has been facing trial in the aforesaid matters for last more than 10 years and the trial is still pending. It has been submitted that due to prolonged trial of the case, the right of the petitioner to speedy trial as guaranteed under Article 21 of the Constitution of India, is getting violated. It has further been submitted that the petitioner is retiring in near future and in case the challans are not finally decided, he may face difficulty in getting his retiral benefits.
Having regard to the nature of the prayer made in the petition, the same can be disposed of at this stage by extending appropriate directions to the learned Special Judge, CBI Cases, Srinagar.
Accordingly, the petition is disposed of with a direction to the learned Special Judge, CBI Cases, Srinagar to expedite the trial of the case and fix a calendar for examination of the witnesses in this regard. The trial shall be concluded preferably within a period of one year. The respondents shall extend all cooperation in production of prosecution witnesses before the learned Special Judge.
Copy of this order be sent to Special Judge, CBI Cases, Srinagar for information and compliance.
