Muchahari, learned Standing Counsel appearing for the Secondary Education Department, Assam. 2. By way of the present writ petition filed under Article 226 of the Constitution of India, the petitioner has assailed the inaction on the part of the respondent authorities in not considering his representation dated 04.12.2025 submitted before the respondent No. 2, seeking appointment as the Principal-in-Charge of Boginadi Higher Secondary School, Lakhimpur. 3. The brief facts of the case are that the petitioner was appointed as an Assistant Teacher in Boginadi Higher Secondary School, Lakhimpur, on 06.10.1993 and has been serving in the institution for nearly 32 years. By order dated 11.05.2023, the respondent No. 2 entrusted the petitioner with the additional responsibility of functioning as the Principal-in-Charge of the said school, besides discharging his regular duties as a Post Graduate Teacher. 4. The said order, however, came to be challenged by one Sri Binod Basumatary by filing WP(C) No. 3227/2023 before this Court. In the said writ petition, this Court, by an interim order dated 14.06.2023, directed the respondent No. 3 to hold the charge of the office of the Principal-in- Charge of the school. Subsequently, during the pendency of the writ petition, the said writ petitioner, Sri Binod Basumatary, retired from Page No.# 3/3 service. Consequently, the writ petition was dismissed on 28.02.2025, whereupon the interim order dated 14.06.2023 also stood vacated. 5. Following the dismissal of the writ petition and vacation of the interim order, the petitioner submitted representations dated 03.03.2025 and 04.12.2025 before the respondent Nos. 2 and 3 respectively, requesting that he be permitted to resume the charge of Principal-in- Charge of the school in terms of the earlier order dated 11.05.2023. 6. Having heard the learned counsel appearing for the parties and upon perusal of the materials available on record, it appears that the petitioner’s representation dated 04.12.2025 is still pending consideration before the competent authority. Since the respondent authorities had earlier appointed the petitioner as the Principal-in-Charge by order dated 11.05.2023, this Court is of the considered opinion that no useful purpose would be served by keeping the present writ petition pending. 7. Accordingly, the writ petition is disposed of by directing the respondent No. 2 to consider and dispose of the petitioner’s representation dated 04.12.2025 by passing a reasoned order, in accordance with law, within a period of three weeks from the date of receipt of a certified copy of this order. 8.
