GP FOR FISHERIES 3 The Court made the following Order:- The learned counsel appearing for the petitioner submits that, at the behest of third parties, the 4th respondent has interfered with the aquaculture activity undertaken by the petitioner in R.S. No.222 of Bethapudi Village, Bhimavaram, West Godavari District. 2. It is submitted that the petitioner is the owner and possessor of the subject land admeasuring Ac.3.00 cents in R.S. No.222 and, in order to undertake aquaculture activity in the said property, had dug up the land. It is submitted that the 4th respondent, without issuing any prior notice to the petitioner, has destroyed the ponds. 3. It is further submitted that, as per the web portal of the 4th respondent, the subject land in R.S. No.222 is classified as an Aqua Zone. It is submitted that, once the land is classified as an Aqua Zone, the landlord can apply online for grant of requisite permission and an aquaculture licence. 4. The learned Standing Counsel appearing for the 4th respondent submits that, once the land is classified as an Aqua Zone, the landlord can apply online for grant of the requisite permission and licence, subject to fulfilling the guidelines prescribed under the applicable Act and Rules of the Andhra Pradesh State Aquaculture Development Authority (APSADA) Act, 2020. It is further submitted that, on account of the pendency of the present writ petition, the application could not be considered further. 4 5. In view of the above, the writ petition is disposed of leaving it open to the petitioner to submit the requisite/additional documents, as required by the 4th respondent, for consideration of the petitioner's application for grant of the requisite permission/licence. There shall be no order as to costs.
