1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.88/2026 registered at Police Station Madanganj, District Ajmer for the offences under Sections 8/22 of NDPS Act.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated for the offence under Section 8/22 and Section 8/29 of NDPS Act. It is further contended that quantity of contraband article i.e. M.D. is 47.9 gram recovered from the petitioner's possession, is below commercial quantity and charge-sheet has already been filed. The petitioner is in custody since 10.04.2026 and further trial of the
[2026:RJ-JP:24664] (2 of 2) [CRLMB-8033/2026] case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application and contended that petitioner is a habitual offender and one case registered against him is related to NDPS Act, therefore, the bail application may be dismissed.
4. Heard and perused the material available on record.

Considering the arguments advanced by the learned counsel for the petitioner and looking to the fact that recovered quantity of contraband article is below commercial quantity and petitioner is in custody since long and further trial of the case may take considerable time, there are no criminal antecedents against the accused-petitioner, therefore, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Salim S/o Shri Sardar in connection with FIR No.88/2026 registered at Police Station Madanganj, District Ajmer shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
