The petitioner is apprehending his arrest in connection with Daltonganj Sadar PS Case No.78 of 2025, for offence registered under section 323, 303(2), 317(2), 3(5) of BNS, Section 4 and 21 of Jharkhand Mines and Minerals (Development and Regulation) Act, 1957, Rules 4 and 54 of Jharkhand Mines and Minerals Concessions Rules, and Rules 9 and 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in court of learned Chief Judicial Magistrate, Palamau. 3. Learned counsel for petitioner submits that the petitioner happened to be owner of Hywa Truck and the allegations are made of loading 700 cft stone chips on the said vehicle. He also submits that the petitioner was also made accused in another case and that has been settled after paying fine by the petitioner. He next submits 2026:JHHC:3205 2 that the driver has loaded the said stone chips on the consignment booked by another person. 4. Learned State counsel opposes prayer and submits that illegally the stone chips were being loaded. 5. Considering that the petitioner happened to be owner of the Hywa truck in question and it has been pointed out that the consignment was booked by another person and the said vehicle was being driven by the driver, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within four weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Palamau, in connection with Daltonganj Sadar PS Case No.78 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
