1. Heard Mr. Pathan, learned Counsel appearing for the Applicant and Mrs. Yadav, learned APP appearing for the Respondent-State. 2. This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (“BNSS”) seeking pre-arrest bail in connection with C.R. No.44 of 2026 registered with Market Yard Police Station, Pune City, Pune, for the offences punishable under Sections 25 and 4 of the Arms Act, 1959, Sections 135, 37(3) and 37(1) of the Maharashtra Police Act, 1951 and Sections 352, Page 1 Sonali
35-ABA-2442-2026.DOC 189(4), 189(2) and 118(2) of the Bharatiya Nyaya Sanhita, 2023 (“BNS”). 3. The prosecution case is set out in paragraph Nos.2A to 2D of the Anticipatory Bail Application, which reads as under:
“2. That the facts leading to the present application are capsulized herein for sake of brevity and convenience. A. The prosecution case is that, on 24.03.2026 at about 7:30 p.m., the complainant Rohitsingh Surjitsing Bhond was present at his residence situated at Rathi Ramnagari, Bibwewadi, Pune along with his family members. On that day, the complainant's wife Nehakor Bhond returned to her matrimonial home along with her mother Dipmalakor Junni and their minor daughter. A dispute allegedly arose between the complainant's family and the relatives of his wife regarding a family matter. During the course of the quarrel, it is alleged that the complainant slapped his wife, whereupon her mother informed her relatives about the incident. B. It is further alleged that at about 8:30 p.m., accused persons namely Sagarsing Junni, Pillusing Junni, Krishnasing Junni, Amolsing Junni, Savansing Junni, Avtarsing Junni, Shankarsing Junni and others arrived at the complainant's residence and formed an unlawful assembly. According to the prosecution, the accused persons started quarreling with the complainant and his family members. During the Page 2 Sonali
35-ABA-2442-2026.DOC said incident, accused Pillusing Junni allegedly assaulted the complainant's brother Ronaksing Bhond with a dagger-like knife and stones, causing injuries to his head and back. It is further alleged that thereafter the accused persons assaulted the complainant's father Surjitsing Bhond with a knife-like weapon and stones, causing injuries to him C. The prosecution further alleges that when the complainant intervened to rescue his father, he was also assaulted by the accused persons and sustained injuries. Thereafter, the injured persons were shifted to Suraj Hospital and subsequently to other hospitals for medical treatment.
D. Thereafter the present Complaint came to be registered on 25/03/2026 against the present Applicants u/s 118(2),189(2),189(4) and 352 of BNS, U/s 4 and 25 of Arms Act 1959 and U/s 37(1),37(3) and 135 of Maharashtra Police Act.”
4. Perusal of the prosecution case shows that the Applicant and the injured are close relatives. The alleged incident has taken place as the First Informant’s wife was not calling the Complainant’s father on a video call. 5.
Learned Counsel appearing for the Applicant submits that although there are two other antecedents, the Applicant has been released on bail in those antecedents and that the Applicant is not Page 3 Sonali
35-ABA-2442-2026.DOC involved in the crime. He submits that the accused Nos.1 and 7 are involved in the crime and they have been arrested and chargesheet has been filed against them and they have been released on regular bail.
6. As the Applicant and the First Informant are relatives and although the Applicant’s name is mentioned in the FIR, no active role is attributed to the Applicant, the case is made out for grant of Anticipatory Bail by imposing stringent conditions.
7. In view thereof, the following order is passed:
O R D E R (a) In the event of arrest of the Applicant-Savansingh Kalusingh Junni in connection with C.R. No.44 of 2026 registered with the Market Yard Police Station, Pune City, Pune, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.30,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the concerned Police Station on every Sunday between 11:00 a.m. to 02:00 Page 4 Sonali
35-ABA-2442-2026.DOC p.m. and shall cooperate with the investigation. In addition, the Applicant shall attend the concerned Police Station as and when called by the Investigating Officer. (c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto. (d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel. (e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner. (f) The Applicant shall not leave India without prior permission of the Court. Page 5 Sonali

8. The Anticipatory Bail Application is disposed of accordingly.
