JUSTICE V SRISHANANDA ORAL ORDER After addressing the arguments for some time, counsel for the petitioner has filed a memo. Counsel for the respondent is absent. 2. Contents of the memo reads as under: “The petitioner above named begs to submit as follows:- 1. The petitioner above named submit that the respondent filed private complaint before the 27th ACMM, Bengaluru the petitioner convicted under section 138 of NI Act. For a sum of Rs.9,00,000/- in default of payment of the said fine amount the accused shall undergo simple imprisonment for period of six months. Out of fine amount Rs. 8,90,000/- to - 3 - HC-KAR NC: 2026:KHC:24580 CRL.RP No. 1022 of 2019 the complainant as compensation and remaining amount Rs.10,000/- shall go to the state. 2. It is submit that the petitioner was chit member of the respondent/complainant, the complainant running chit business the petitioner has bid the chit the complainant has issued the prized amount for a Rs.7,49,900/- on 28/11/2015. The petitioner has paid the chit amount and the respondent has collected amount from 15/07/2011. 3. The petitioner bid the chit and petitioners father has guarantor, the respondent has collected the site documents of the petitioner's father and also 3 blank cheques received from the petitioner. After some time the petitioner has not paid the amount to the respondent. The respondent has presented the cheque in its account for sum of Rs.8,50,000/-same as dishonoured with an endorsement funds insufficient thereafter filed private complaint and examined himself as a PW1 and produced document Exhibit P1 to P7. Petitioner examined as Dw1 and marked Exhibit D1. The trial court has convicted the petitioner and imposed fine amount for a sum of rupees nine lakhs. 4. The petitioner has deposited the amount for a sum of Rs.90,000/- on 26/05/2018 as per direction of Hon'ble sessions court the petitioner as drawn the DD in favour of the trial court in DD No.200799 dated 24/05/2018 the trial court same as accepted. As per direction of this Hon'ble court deposited for a sum of - 4 - HC-KAR NC: 2026:KHC:24580 CRL.RP No. 1022 of 2019 Rs.4,50,000/- on 03/10/2019 before the Hon'ble trial court. Totally for a sum of Rs. 5,40,000/-has deposited. 5. It is submit that the petitioner is ready to pay the balance amount for a sum of Rs.3,60,000/- on at the instalment basis with in six months on every month equal instalments amount for a sum Rs.60,000/- on every month i.e., 30/05/2026, 30/06/2026, 30/07/2026, 30/08/2026, 30/09/2026, 30/10/2026 the petitioner is agree to deposit on every instalment on or before aforesaid dates. Wherefore the petitioner pray be pleased to acquit the petitioner under section 138 on NI Act and direct the respondent to release the site documents and another cheques kept in their custody in the interest of justice.” 3. Placing the memo on record, petition stands disposed of. 4. Amount in deposit is ordered to be withdrawn by the complainant/respondent under due identification. 5. Balance amount is to be paid by the petitioner as per the memo in instalments. 6. It is made clear that if any default in the payment of compensation amount as agreed in the memo, petitioner - 5 - HC-KAR NC: 2026:KHC:24580 CRL.RP No. 1022 of 2019 shall undergo imprisonment as ordered by the learned Trial Magistrate, confirmed by the First Appellate Court.
