ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents.

Learned counsel for the petitioner submits that the petitioner filed an application in Form No.53 on 22.11.1998 seeking regularisation of unauthorised occupation of 2 acres of land in Survey No.61 of T.Agrahara Village, Hoskote Taluk, Bangalore Rural District. However, the petitioner realized that he was in unauthorised occupation of Survey No.29 of

Sashimanakanahalli Village and not Survey No.61. Therefore, the petitioner gave a representation to the Tahsildar, Hoskote Taluk, to make necessary corrections in the application filed by the petitioner and consider the application filed by the petitioner. However, the Tahsildar issued the impugned endorsement at Annexure-E dated 05.07.2025, stating that he does not have the power to consider the request made by the petitioner. Learned counsel submits that it is the Tahsildar or the Committee for regularisation of unauthorised occupation which is required to consider the application before making necessary corrections.
3. There is substance in the submission made by the
learned counsel for the petitioner, the Tahsildar could not have rejected the application given by the petitioner while simply stating that he does not have the power to make necessary corrections in the application filed by the petitioner.
4. Accordingly, the writ petition is allowed. The impugned endorsement at Annexure-E dated 05.07.2025 issued by the Tahsildar, Hoskote Taluk, is hereby quashed and set aside. The respondent-Tahsildar is hereby directed to place

the application filed by the petitioner in Form No.53 along with the representation given by the petitioner for correction of the survey number along with his recommendation before Committee for regularization within a period of six weeks from the date of receipt of a copy of this order. The Committee shall thereafter consider the application and the request made by the petitioner and pass necessary orders as expeditiously as possible and at any rate within a period of two months from the date when which the application would be placed by the Tahsildar before the Committee.
Ordered accordingly.
Learned High Court Government Pleader is permitted to file memo of appearance within a period of four weeks from today.
