Petitioner has filed the present petition for the following reliefs: “10.1 That the Hon’ble Court may kindly be pleased to declare the note i.e. The teachers of the subject mentioned in serial numbers 8 to 10 shall be appointed in higher secondary schools, for them B.Ed/D.Ed, and TET qualification will not be necessary” appended to Annexure-1 (ii) of Chhattisgarh School Education Services (Educational and Administrative Cadre) Recruitment Rules, 2019 as ultra vires. 10.2 That the Hon’ble Court may kindly be pleased to set aside and quash the impugned note i.e. The teachers of the subject mentioned in serial numbers 8 to 10 shall be appointed in higher secondary schools, for them B.Ed/D.Ed, and TET qualification will not be necessary” appended to Annexure-1 (ii) of Chhattisgarh School Education Services (Educational and Administrative Cadre) Recruitment Rules, 2019. 10.3 That the Hon’ble Court may kindly be pleased to direct the Respondent authorities to incorporate the changes in the rules 2019 and publish the same in the Official Gazzette in compliance of this Hon’ble Court’s order declaring persons having graduation in agriculture eligible as teacher for the post of teacher and post graduation in agriculture eligible as lecturer for the post of lecturer. 10.4 Any other relief as deemed fit by this Hon’ble Court may also be granted in favour of the petitioner.” wps13148 of 2025 3 2. The instant petition has been filed by the petitioner being aggrieved by the note appended to Annexure1 of the Chhattisgarh School Education Services (Educational and Administrative Cadre) Recruitment Rules, 2019 (for short, ‘CG Rules, 2019’). 3. Learned State counsel has pointed out that new Chhattisgarh School Education Services (Educational and Administrative Cadre) Recruitment Rules, 2026 (New Rules, 2026) have been framed on 13th February, 2026, whereby the petitioner’s grievance would be redressed. He would further submit a copy of New Rules, 2026 and states that the same will be filed during course of the day. Pursuant to the decision taken by the Hon’ble Court in WPS-3309 of 2024, fresh rules have been incorporated wherein the relaxation, which is the subject matter of dispute in the petition has been done away with and the direction issued by the Hon’ble Court has also been duly complied with. 4. In view of above submission made by learned State counsel that by the issuance of Rules of Chhattisgarh School Education Services (Educational and Administrative Cadre) Recruitment Rules, 2026 the grievance of the petitioner has been redressed, and the matter stands disposed of.
