Mr. Amal Krishna Samanta …for the petitioner Mr. Arindam Sen Mr. Kunal Ganguly … for the State Learned counsel appearing on behalf of the petitioner submits that he has been falsely implicated in this case. His name was not there in the FIR but he has been charge sheeted. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the statements of witnesses, which implicate the petitioner. He also refers to the injury reports regarding injuries sustained by the public servants, at least one of which has been recorded as grievous. The prayer for anticipatory bail of some other co-accused was earlier turned down by this Court. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
