Learned advocate for the petitioner submits that from the joint possession of the petitioner and another 2.515 kg of morphine were recovered and the petitioner is in custody for about three years. Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that the evidence of the Investigating Officer of the case is in progress which is the last witness in the case. It has been informed that the evidence of such Investigating Officer commenced in the month of June, 2025. Having considered the stage of the case, I am not inclined to enlarge the petitioner on bail.
2 Hence, the prayer for bail of the petitioner is Rejected. However, the learned trial court would complete the evidence of the witnesses within 60 days from the next date fixed. Accordingly, CRM(NDPS) 476 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
