1. Heard Mr. U. K. Barman, learned counsel appearing for the accused petitioners as well as Mr. B. Sharma, learned Addl. P.P., Assam appearing for the State respondent.
2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioners, namely, Hafijul Islam and Abdul Kalam, praying for
Page No.# 2/2 grant of bail in connection with Jogighipa P.S. Case No.79/2026 under Sections 61(2)/3(5) of BNS read with Section 13(1)/14/16 of Assam Cattle Preservation Act, 2021.
3. The petitioners are stated to be the owner and cook respectively of the hotel where alleged meat in the nature of beef was found in violation of the provisions of section 8 of the Assam Cattle Preservation Act.
4. The case diary has been received.
5. The Prosecution submits that investigation has progressed and statements of witnesses have been recorded.
6. In that circumstances, it is provided that the accused petitioners named above, shall be released on bail of Rs.30,000/-each with one suitable surety of like amount each to the satisfaction of learned concerned court subject to the following conditions that the petitioners: (a) shall co-operate the remaining investigation. (b) Shall not hamper or tamper with the evidence
7. Accordingly, this bail application stands allowed and disposed of.
