No. 448 of 2026 ORDER This petition is filed seeking direction to the second Respondent to pass a reasoned order or unfreeze the petitioner’s father bank Account No.1625173000005217, Karur Vysya Bank, Perambalur Branch and Twenty other Bank accounts based on the petitioner's representation dated 30.01.2026 within a reasonable time to be fixed by the Court. 2. The contention of the petitioner is that one Machendranathan, filed a complaint before the Cyber Crime Police stating that on the false promise of getting job in abroad, a sum Rs.4,42,000/- was received. Subsequently, CSR 242 of 2025 dated 16.09.2025 registered and Cyber Crime Police issued orders to freeze the petitioner's father bank account. The petitioner uses his father’s bank account for certain transactions. Due to the freezing of the petitioner's father Bank account, he is unable to carry on his day to day activities and his entire hard earned money not accessible, no transaction can be made and thereby causing great hardship. 3. The learned Public Prosecutor submitted that in the present case, the Inspector of Police, Cyber Crime sent a communication to the Nodal Officer of HDFC Bank, stating that Machendranathan lodged a complaint on 16.09.2025 claiming that the petitioner published an advertisement for a job in abroad and __________ Page2 of 5 https://www.mhc.tn.gov.in/judis WP Crl. No. 448 of 2026 collected amount to the tune of Rs.4,42,000/- and received in the petitioner’s father Bank account. It is further stated that this amount is liable to be returned to Machendranathan. 4. Considering the submissions and on perusal of materials, it is seen that the Cyber Crime Police after verification found that the petitioner received the amount of Rs.4,42,000/- from Machendranathan and the amount does not belong to the petitioner. Hence, this Court issues the following directions: i) The amount of Rs.4,42,000/-to be recredited to the account of Machendranathan. ii) Defreeze the bank account of the petitioner’s father so that Machendranathan can receive his amount. iii) The Cyber Crime Police can send defreezing instructions to the petitioner’s father account No.1625173000005217 in Karur Vysya Bank, Perambalur Branch after verifying and satisfying there is no other doubtful transaction. 5.
