Bill dated 02.08.2026 pending disposal of the above writ petition Counsel for the Petitioner: C B ADARSH KUMAR Counsel for the Respondents: GP FOR ENERGY The Court made the following order: 4 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 24500 OF 2026 ORDER:- This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:- “to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent Nos.2 to 7 in billing 981 units and 864 units under C.C. Bills dated 09.06.2026 and 02.07.2026 on the defective Meter No.5790086 of Service Connection No.3711103002124, Bapatla Town, and in demanding Rs.8,460/- under C.C. Bill dated 02.08.2026 with disconnection date 02.09.2026, contrary to the Examination Report of the LT Meters Lab, Bapatla, dated 18.07.2026, as illegal, arbitrary, violative of Articles 14 and 21 of the Constitution of India and contrary to Sections 55 and 56 of the Electricity Act, 2003, Clause 7.5.1.4.1 of the General Terms and Conditions of Supply and Clauses 4.7.1 and 4.7.3 of the A.P. Heard learned counsel for the petitioner and learned Standing Counsel for the respondents. 3. Learned counsel for the petitioner submits the respondents issued C.C. bills dated 09.06.2026 and 02.07.2026 alleging the defective Meter bearing No.5790086 of Service Connection No.3711103002124, Bapatla Town, and demanding Rs.8,460/- under C.C. bill dated 02.08.2026 threatening with disconnection dated 02.09.2026, contrary to the Examination Report of the LT Meters Lab, Bapatla, dated 18.07.2026. Therefore, such 5 demand is illegal. He further submits that by threat of disconnection, the respondents collected the entire amount of Rs.8,460/- out of which the petitioner is entitled to a refund Rs.7,010/-. Hence, the Writ Petition. 4. On the other hand, learned Standing Counsel for the respondents furnished written instructions dated 02.09.2026, wherein it is stated as follows: “a) As per the consumer representation wide ref(1) cited above, an Enquiry on Sc.No.3711103002124 was conducted on 14.07.2026 through field staffs, based on field verification we suggested him to apply meter testing through Mee-Seva, and also informed that payment CC bill amount of Rs.7,010/- during 06/26 month will be refunded to his future CC bills as per the MRT Lab report. f) An amount of Rs.14,764/- was refunded to his CC bill on 26.08.2026. And also an amount of Rs.6,305/- was CC bill excess after clear of all arrears from 06/26 to 08/26 which was carried forward to his future CC bills. The above all information was also communicated to both Sri Inapakolla Venkata Narasimha Rao, S/o.Sriramulu and his son Sri Inapakolla Bharat Kumar through Whats up time to time.” 5. She further submits that the amount was refunded by the respondents on 26.08.2026. In view of the refund of the amount, no further orders are necessary in the present Writ Petition. 6. In reply, learned counsel for the petitioner submits that the respondents are liable to issue revised bill under which they collected excess 6 amount and amount which was already refunded in view of the instructions on 26.08.2026. 7. Considering the submissions made by both the learned counsel and on perusal of the material placed on record, this Court is of the considered opinion that the present Writ Petition can be disposed of. However, the petitioner is hereby directed to submit a detailed representation seeking for furnishing a detailed revised bill for the months of July and August, 2026, within a period of one (1) week from the date of receipt of copy of this Order. After such submission of the representation, the respondents more particularly respondent Nos.5 and 6 are directed to consider the same and pass appropriate orders as requested by the petitioner, within a period of four(4) weeks thereafter. 8. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
