This is First anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 1122/2025 registered at Police Station – Baloda, District – Baloda Bazar - Bhatapara (C.G.) for the offence punishable under Section 3(5), 308(3), 316(5), 318(3), 318(4) of Bhartiya Nyay Sanhita, 2023. 2. Prosecution case in brief is that the complainant lodged FIR against the applicant alleging that the applicant who was placed with the work order for transportation of coal had in connivance with other VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.01.28 10:36:19 +0530 2 accused persons adulterated coal with stones, dust and payment of penalty to the company who in fact placed the order of transportation to the complainant. 3. Learned counsel for the applicant submits that the applicant is an innocent person and has been falsely implicated in the present case. It is contended that the applicant is the proprietor of M/s S.S. Traders and is engaged in the business of transportation of coal on behalf of contractors. The complainant, through his companies namely M/s Hind Minerals and M/s Balaji Minerals, placed various transportation orders with the applicant for supply of coal to its clients, mainly cement companies having coal linkages with SECL. It is further submitted that the allegation that instead of coal, stones, dust and fines were supplied is false and baseless. The coal is loaded by SECL at its dispatch center and thereafter the trucks are directly sent to their respective destinations. There is no occasion or opportunity for unloading or tampering with the coal during transit. Learned counsel further submits that a similarly situated co-accused has already been granted anticipatory bail by this Court in MCRCA No. 2000 of 2025 vide order dated 06.01.2026. On the ground of parity, the applicant is also entitled to the benefit of anticipatory bail. 4. On the other hand learned counsel for the State opposes the bail application. 5. I have heard learned counsel for the parties and perused all of the documents taken on record. 6. Considering the overall facts and circumstances of the case, the nature of allegations, the role attributed to the applicant, and the fact that the co-accused has already been granted anticipatory bail by 3 this Court in MCRCA No.2000 of 2025 vide order dated 06.01.2026., this Court is of the considered opinion that the applicant deserves the benefit of anticipatory bail. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Surendra Singh on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
