Kausik (Rejected) CRM (NDPS) 556 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nabagram Police Station Case No. 111 of 2025 dated 23.02.2025 under section 20(b)/29 of the NDPS Act, 1985. Mr. Sanjay Banerjee Ms. Kanchan Roy ……for the State. Learned advocate appearing for the petitioners submits that the petitioners are renewing their prayer for bail as earlier there was a direction under CRM (NDPS) 1276 of 2025 for examination of the seizure list witnesses and although schedule was fixed but the learned Special Court did not fix date for examination of the seizure list witnesses. The next date has been fixed in the month of June, 2026. Learned advocate for the State opposes the prayer for bail and submits that the alleged recovery is for 227.98 Kgs. of Ganja. 2 Having considered the earlier direction passed and taking into account the present scenario existing, I direct the learned Trial Court to give priority for examination of the seizure list witnesses. In case, a pre-schedule has already been fixed thereby indicating the witnesses to be produced by the prosecution, learned Trial Court would accommodate the prosecution and the petitioners in the month of June, 2026 for examination of the seizure list witnesses. Petitioners would be at liberty to approach this Court after the seizure list witnesses are completed. At this stage, there are no change of circumstances, as such, CRM (NDPS) 556 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
