This writ petition has been filed by the petitioner claiming following reliefs : PAWAN KUMAR Digitally signed by PAWAN KUMAR Date: 2026.02.26 11:59:41 +0530 2 (I) That, the Hon'ble Court may kindly be pleased to direct the learned Second Additional Principal Judge Family Court Raipur District Raipur Chhattisgarh to decide pending case M.C.C. No. 1301/2023 within time framed, in the interest of justice. (ii) Any other relief, which the Hon'ble Court may deem fit and proper in the facts and circumstances of the case may also be granted in favour of the petitioners. 3. Learned counsel for the petitioners submits that the petitioners are the minor children and the wife of the respondent. He further submits that the petitioners have filed an application under Section 125 of the Code of Criminal Procedure, 1973 (for short, CrPC, 1973) before the learned Second Additional Principal Judge, Family Court, Raipur, Chhattisgarh, on 29.11.2023, which has been registered as Case No. 1301/2023. He submits that interim maintenance has been granted by the learned Family Court. It is further submitted that the case is presently at the stage of evidence on behalf of the respondent but the respondent is not cooperating with the early disposal of the said application. Therefore, it is prayed that the learned Family Court be directed to decide the said application expeditiously within a stipulated period of time. 4. Heard learned counsel for the petitioner and perused the documents on record. 5. Taking into consideration the submissions made herein-above, this Court is not inclined to fix any time frame to the learned Family Court to decide the case. However, considering the fact that the case has been pending since 29.11.2023 and that the dispute pertains to the grant of maintenance to the minor children and the wife, it is expected that the learned Family Court shall expedite the hearing of the case and make all endeavours to decide the same within a reasonable period of time, without granting unnecessary adjournments. 3 6.
