Rakib (Allowed) CRM (NDPS) 535 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Daulatabad Police Station case no. 0258 of 2025 dated 19.08.2025 under Sections 21(C)/29 of the Narcotic Drugs Psychotropic Substances Act, 1985. And In the matter of : Tohidul Sk @ Akash @ Tahidul Sk. ……Petitioner. Mr. Tapodip Gupta Mr. Suman Bhanja Mr. Golam Ahammed ……for the Petitioner. Mr. Avishek Sinha Mr. Asif Dewan ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than seven months, charge-sheet has already been submitted and prosecution has relied upon 14 witnesses in order to prove its case. Learned advocate for the State opposes the prayer for bail and submits that date has been fixed for consideration of the charges by the learned Special Court. Having regard to the fact that 14 witnesses have been cited by the prosecution some time will be required for taking the trial to its logical conclusion, considering the detention of the petitioner, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, petitioner namely, Tohidul Sk @ Akash @ Tahidul Sk shall be released on bail upon furnishing bond of Rs. 2 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act cum learned Additional Sessions Judge, 5th Court, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present before the learned Special Court on each and every date and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 535 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
