2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 132, 109(1) and 3(5) of the B.N.S., Section 30 (a) of the Bihar Prohibition and Excise Act and Section 25 (1-b)a, 26 and 27 of the Arms Act.
3. A bare perusal of the first information report and the seizure list would go to show that 752.600 liters of foreign liquor has been recovered from a boat.
4. It is submitted by learned counsel for the petitioner that no recovery has been made from the conscious physical possession of the petitioner rather the same has been recovered from a boat, which does not belong to the petitioner, hence the liability cannot be fastened on the petitioner. The name of the petitioner has transpired in this case on the basis of disclosure
Patna High Court CR. MISC. No.19476 of 2026(2) dt.06-04-2026 2/2 made by an apprehended co-accused, which has no evidentiary value in the eye of law. Petitioner has no criminal antecedent as stated in para-3 of this application.
5. Learned APP for the State opposed the prayer for bail.
6. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Manjhi P.S. Case No.446 of 2025, subject to the condition as laid down under Section 482 (2) Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
