JUSTICE PRAVEER BHATNAGAR Order 02/07/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of the accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 172/2025 registered at Police Station Ranpur, District Kota City for offence under Sections 8/20 of NDPS Act, 1985. 2. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the recovered contraband article, i.e., Ganja weighing 28 Kgs and 10 grams was effected from the possession of the other co- accused Ashif Mohammad and apart from the disclosure statement of other co-accused, there is no substantive evidence available on the record indicating petitioner's involvement in the alleged crime. There are no criminal antecedents registered against the accused- [2026:RJ-JP:24392] (2 of 2) [CRLMB-7847/2026] petitioner. The accused-petitioner is behind the bars since 16.04.2026, charge-sheet has already been submitted and further trial of the case may take considerable time, therefore, the bail application of the petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application. 4. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the petitioner and more particularly, the fact that apart from the disclosure statement of the other co-accused Ashif Mohammad, there is no connecting evidence available on record. The petitioner is in custody since 16.04.2026 and further trial of the case may take considerable time, therefore, without commenting on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Sunil Rav @ Gallu S/o Sodan Rav, arrested in connection with FIR No. 172/2025 registered at Police Station Ranpur, District Kota City shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
