1. Mr. Prince Chauhan, learned counsel for the applicant through Legal Aid.
2. Mr. Amit Kapri learned counsel for the respondent.
3. All attempts were made by this Court for amicable settlement, since, the dispute appears to be matrimonial one but fails. The applicant and the respondent are living separately since 2017, i.e., almost for 8 to 9 years and there is no issue from this marriage, and, prima facie, it appears that it is a dead marriage. It has been apprised that none of the party have filed any suit for seeking divorce and this petition has been moved for expediting the proceeding of Criminal Case No. 4 of 2025 (Old No. 15 of 2025) Smt. Pooja Rawat vs. Dipesh Rawat, preferred under Section 20(1)(d) of Protection of Women from Domestic Violence Act pending in the court of Judicial Magistrate/Civil Judge (Jr. Div.) Pithoragarh District Pithoragarh.
4. By this petition, the present applicant is praying for expeditious disposal of proceeding which is pending since 2025.
5. Since attempts for their amicable settlement fails, therefore, this Court has no option except to direct the concerned court to expedite the pending proceeding.
6. In such view of the matter, the instant

2026:UHC:6460 petition is disposed of with the direction to the learned Judicial Magistrate/Civil Judge (Jr. Div.) Pithoragarh District Pithoragarh to expedite the proceeding of Criminal Case No. 04 of 2025 (Old No. 15 of 2025), Smt. Pooja Rawat vs. Dipesh Rawat, as early as possible preferably within a period of four month from the date of production of certified copy of this order.
