Dr N S Bhatnagar --Petitioner Versus State of Uttarakhand and another --Respondents
Hon’ble Manoj Kumar Tiwari, J. Mr. Shashank Pandey, Advocate with Mr. Akshay Pradhan, Advocate for the petitioner. Mr. Yogesh Pandey, Deputy Advocate General for the State.
2. Petitioner claims to be member of the founder family of Mahadevi Kanya Pathshala College Society, which runs various educational institutions, including a Post Graduate College in Dehradun. Petitioner has challenged order dated 03.06.2026, passed by Deputy Registrar, Firms, Societies and Chits, Dehradun, whereby members of the aforesaid society were called upon to provide the list of members of the society to enable him to initiate process of preparing electoral roll.
3. Petitioner has also challenged subsequent order dated 17.06.2026, passed

2026:UHC:6399 by Deputy Registrar, whereby the Institution was required to produce original record, namely, proceedings register and membership receipts in his office within 15 days.
4.
Learned counsel for the petitioner contends that the bye-laws of the society were amended in 2007; however, Deputy Registrar disallowed that amendment and this Court affirmed the decision taken by the Deputy Registrar and the Society filed SLP against order passed by this Court; however, it was later withdrawn. Various other
contentions have been raised by learned counsel for the petitioner.
5. This Court finds substance in the contention raised by learned State Counsel that writ petition is premature, as the members of the society have simply been asked to furnish the relevant record which may facilitate holding of election.
6. He submits that there is direction issued by this Court to the Deputy Registrar to reconstitute managing committee.
7. Having regard to the fact that no prejudice is caused to the petitioner by the

2026:UHC:6399 impugned orders and members of the society have only been asked to furnish the records available with them, there is no scope for interference in the matter.
8. The writ petition, however is disposed of with liberty to petitioner to raise objection, if any, before the Registrar, Firms, Societies and Chits, Dehradun. Objection, if raised by petitioner shall be dealt with by Deputy Registrar, as per law, before holding election.
