Rakib (Rejected) CRM (NDPS) 530 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Malda Police Station case no. 773 of 2025 dated 05.11.2025 under Sections 21(C)/22(C)/23(C)/25/27A of the Narcotic Drugs Psychotropic Substances Act, 1985. And In the matter of : Afsar Ali & Anr. ……Petitioners. Mr. Avinaba Patra ……for the Petitioners. Mr. Iqbal Kabir Ms Jonaki Saha ……for the State. Learned advocate appearing for the petitioner submits that the subject matter of the case relates to alleged recovery of 25 bottles of phensedyl. The investigation of the case is in progress and the petitioners are in custody for five months. Learned advocate for the State submits that recoveries have been effected from the house of the present petitioners. Having considered the quantum of recovery and the period of detention, I direct the learned Special Court that if there are no further recovery in connection with the instant case, the learned Special Court will release the petitioners on bail after the charge-sheet is submitted in connection with the instant case. With the aforesaid observations CRM (NDPS) 530 of 2026 is disposed of. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
