Mr. Asraf Mondal … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner has been detained on the accusation of alleged recovery of 26.310 kg of ganja from the petitioner and others. According to the learned advocate, three other accused persons have been granted bail; the petitioner is in custody for seven months; charge-sheet has already been submitted and charges have been framed, as such, the petitioner may be enlarged on bail. Learned advocate for the State submits that the prosecution has materials to prove the charges against the present petitioner by way of adducing 22 witnesses. Having considered that charges have been framed and similarly placed accused persons have been granted bail as also the fact that there are 22 witnesses proposed to be 2 examined by the prosecution, I am of the view that some time will be consumed in taking the trial to its logical conclusion. Having considered the same, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Chandan Mondal shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act, Berhampore, Murshidabad. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court and shall not leave the district of Murshidabad without prior intimation to the learned Special court.
