And
In the matter of: Ashadul Islam & Anr.
… petitioners
Mr. Kazi M. Rahman. …for the petitioners.
Mr. Arijit Ganguly, Mr. Tiruputi Mukherjee.
..for the State.
Learned counsel appearing on behalf of the petitioners submits as follows. A scuffle took place between the private parties. None of the injuries received were grievous in nature.
Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the FIR and the statements of witnesses. He also refers to the bed-head ticket and the other injury reports of the victim. It is alleged that the petitioners tried to assault the wife of the main victim. When the main victim came to rescue her, he was severely assaulted. There were injuries inflicted on different parts of the body, including three lacerated wounds on a vital part of the body like the forehead. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail to the present petitioners. The application for anticipatory bail of the petitioners is, thus, rejected.
2 Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
