The grievance of the petitioner is directed against the failure of WBSEDCL to provide an electricity connection to the petitioner. It is submitted on behalf of the WBSEDCL that they are ready and willing to provide an electricity connection to the petitioner subject to a wayleave being provided by the petitioner. On behalf of the petitioner it is submitted that there have been serious objections by the private respondent in providing an alternative route. In view of nature of the disputes raised by the parties, WPA 23372 of 2024 stands disposed of by directing the concerned District Magistrate having jurisdiction to adjudicate upon the grievance of the petitioner and examine whether it is possible to provide an alternative route for the electricity connection to the petitioner’s premises.
2 It is made clear that in carrying out such direction, the concerned District Magistrate would give notice to both the petitioner and the private respondent. The above exercise is to be completed preferably within a period of 12 weeks from the date of communication of this order. It is made clear that there has been no adjudication on the merits of the case and all issues are left open for the concerned District Magistrate to decide strictly in accordance with law.
