Panda, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 22.04.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioners in connection with C.T. Case No.1094 of 2025 pending in the file of learned J.M.F.C., Basta arising out of Basta P.S Case No.509 of 2025 on the grounds stated. 3. Perused the FIR as at Annexure-1. It is submitted to the Court that petitioner No.1 is the owner of the vehicle, whereas, petitioner No.2 is his son and the former is having one more criminal case but not similar in nature. A case under Section 52 of the Odisha Excise Act is registered against petitioner No.1 and considering the same, it is submitted that both the accused should be allowed to go on bail with any conditions, which is seriously opposed by Mr. Panda, learned ASC for the State on the ground that cattle were being transported in a Bolero p. 2 vehicle being tied by ropes with their toes, neck and nose. The vehicle has been seized in connection with the case and as informed to the Court, the cattle are handed over to a Go Seva Kendra. Recording the submission that petitioner No.1 is having only one antecedent but under the Odisha Excise Act and petitioner No.2 does not have any with the objection of the State noted down, this Court though not any favour of considering grant of pre-arrest bail, however, is in favour of directing both to surrender before the learned court below for being released with stringent conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioners surrender before the court of learned J.M.F.C., Basta within fortnight from today, it is directed that they shall be released on bail in connection with C.T. Case No.1094 of 2025 corresponding to Basta P.S Case No.509 of 2025 on furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) each with one solvent surety for the like amount each with such other conditions imposed as deemed just and proper and in the facts and circumstances of the case besides the following, such as, petitioner No.1 shall furnish an undertaking and to attend the PS not to involve himself in similar criminal activities while on bail. The above order, as is further directed, shall not be given effect to if any of the petitioners is having similar antecedents upon verification and enquiry with the assistance of local PS.
