The primary argument on behalf of the petitioner is that the impugned show cause notice was issued pursuant to directions issued by this Court in W.P(C) No. 4463 of 2022 dated 18th September, 2025. 3. Learned counsel for the petitioner has now pointed out that the above referred order made by this Court has been stayed by the Hon’ble Supreme Court in Petition(s) for Special Leave to Appeal (C) No(s). 1585- 1586 of 2026 on 2nd February, 2026. Accordingly, the learned counsel for petitioner has urged that the impugned show cause notice must be kept in 2026:JHHC:7698-DB -2- abeyance until the Hon’ble Supreme Court decides the Special Leave Petition(s) one way or the other. 4. Mr. Gaurav Raj, learned A.C. to A.A.G-II, on instructions from the District Mining Officer, Pakur states that the impugned show cause notice will not be proceeded with until the disposal of the above referred Special Leave Petitions.
