Rakib (Allowed) CRM (NDPS) 534 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Para Police Station case no. 96 of 2023 dated 21.11.2023 under Sections 21(C)/29 of the Narcotic Drugs Psychotropic Substances Act, 1985. And In the matter of : Sagar Osta @ Asta. ……Petitioner. Mr. Ayan Basu Mr. Sk. Salim Mr. Sumit Routh ……for the Petitioner. Mr. Md. Adil Badr, Jr. Govt. Adv, Mr. Rajesh Jana ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than two years four months and was shown arrested in connection with the instant case. There are other cases against the petitioner but the same relate to offences under the BNS, 2023. According to the petitioner the investigating agency in connection with another case went to effect seizure of a motorcycle when it was contended subsequently that there has been recovery of five litre of codeine mixture from his residence. Learned advocate for the State opposes the prayer for bail and submits that there are other dacoity cases against the petitioner. According to the state this is the only NDPS Act case so far as the present petitioner is concerned. Seven witnesses have already been witnesses examined out of thirteen witnesses cited by the prosecution. 2 Having considered the period of detention of the petitioner and that some more time will be required by the prosecution to take the trial to its logical conclusion, I am of the view that further detention of the petitioner so far as this case, is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed. As such, petitioner namely, Sagar Osta @ Asta shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act cum learned Additional District Judge, 3rd Court, Purulia. If on bail, the petitioner shall be physically present before the learned Special Court on each and every date and shall not leave the jurisdiction of District of Purulia without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 534 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
