ORDER:
The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue an appropriate writ or orders more particularly in the nature of writ of mandamus directing Respondent No.2 to Respondent No.5 to take urgent action in removing the unauthorized and illegal constructions and encroachments made on the part of site of Sri Chowdeswari Devatha Temple by the respondent No.7 and to act on the representation dated 2.02.2017, and further direct the Respondent No.6 to provide the necessary Police force to assist the Respondent No.2 to Respondent No.5 in removal of illegal construction and encroachments done by the respondent No.7, and pass such other
order or orders.…”

The present Writ Petition is filed to direct the respondent Nos.2 to 5 to take action for removing unauthorized and illegal constructions and encroachments made on the part of site of Sri Chowdeswari Devatha Temple, on the ground that the petitioner is hereditary pujari of subject temple and it devolved upon him through their forefathers. The rights of the petitioner were established through judgment and decree dated 08.07.1994 in O.S.No.549 of 1903 on the file of District Munsiff, Kurnool. With such devolvement of hereditary pujariship, the petitioner is continuing as archaka of the subject temple. According to the official records, the subject temple is situated in the land admeasuring 308 Sq.Yds, the respondent No.7, who backed political clout and musclemen, had encroached the piece of land belonging to the subject temple and initiated unauthorized construction. Despite the petitioner

filed representation dated 02.02.2017, there is no action from the respondents. Hence, the present writ petition is filed to direct the respondents to protect the property of Sri Chowdeswari Devatha Temple.
3. Heard learned counsel for the petitioner and learned counsel for respondents.

Learned counsel for respondent No.7 has not reported any counter- affidavit.
5. The prayer is only to direct the respondents to safeguard the subject property of the Temple.

Therefore, without adverting into merits of the case, the present Writ Petition is disposed of directing the concerned respondents to take appropriate steps for protecting the land admeasuring 308 Sq.Yds of Sri Chowdeswari Devatha Temple, by following due process of law. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
